Welcome to Mind The Skin, Inc. (“Mind The Skin,” “we,” “us,” or “our”). These Terms and Conditions govern your access to and use of our website, online store, products, and related services (“Services”). By using our Services, you agree to these Terms. Please read them carefully before using the site.
1. Eligibility
You must be at least 18 years old or use our Services under the supervision of a parent or legal guardian. By using our website, you confirm that you have the legal right to enter into this agreement.
2. Use of Our Website and Products
You agree to use our website only for lawful purposes and in accordance with these Terms.

Our products are designed for external use only and are not intended to diagnose, treat, cure, or prevent any medical condition. Always follow directions for use and discontinue if irritation occurs.
3. Orders and Payment
All orders are subject to acceptance and availability. Prices, discounts, and promotions may change at any time without notice.
You agree to provide accurate billing and shipping information. Payment must be made at the time of order through approved payment methods.
If an error occurs in pricing or product information, we reserve the right to correct it and cancel or refund affected orders.
4. Shipping and Delivery
We ship orders to the address provided at checkout. Delivery times are estimates and not guaranteed.
Delays caused by carriers, customs, or events outside our control are not our responsibility, but we will do our best to help resolve issues quickly.
5. Returns, Refunds, and Damaged Orders
5.1 All sales are final
Mind The Skin patches are single-use, hygiene-sealed products designed for application directly to sensitive, eczema-prone, and broken skin. For your safety and the safety of other customers, all sales are final. We cannot accept returns, exchanges, or refunds for any reason once an order has shipped, including but not limited to:
- Change of mind
- Wrong stage, size, or product selected
- Fit, comfort, scent, color, or aesthetic preferences
- Patches that have been opened, applied, partially used, or removed from sealed packaging
- Skin reactions, irritation, or sensitivity (please discontinue use immediately, consult a healthcare provider, and see our FAQ for guidance)
- Damage caused after delivery, including improper storage, handling, or accidental damage
- Dissatisfaction with results or product effectiveness
This policy applies to all purchases, including one-time orders, subscription orders, promotional or discounted purchases, and orders sent as gifts.
5.2 Damaged, defective, or incorrect orders
If your order arrives with a manufacturing defect, transit damage, or items that are missing or incorrect, we will replace the affected items at no cost, subject to the conditions in this section.
To qualify for a replacement, you must:
- Contact us at support@mindtheskinlabs.com within 7 days of the delivery date shown on your tracking confirmation
- Provide your order number and the name on the order
- Provide clear photographs showing all of the following:
- The issue with the product
- The outer packaging, including the visible batch code
- The original shipping label
Claims will not be processed if:
- Photographic evidence is missing, unclear, or incomplete
- The claim is received more than 7 days after the tracked delivery date
- The product shows signs of attempted use, opening, or tampering
- The reported damage is inconsistent with transit damage
- The batch code does not match our manufacturing records
Replacements are issued once the claim is verified. We reserve the right to refuse claims at our sole discretion where evidence is inconclusive, contradictory, or suggests the damage occurred after delivery. Where replacement is not possible (for example, if the affected item is out of stock or discontinued), a refund may be issued at our discretion to the original payment method.
5.3 Late, lost, or delayed deliveries
Delivery times provided at checkout are estimates, not guarantees. If your order has not arrived within 14 days of the estimated delivery date, contact us at support@mindtheskinlabs.com with your order number, and we will work with the carrier to resolve the issue.
Mind The Skin is not responsible for delays caused by carriers, customs authorities, weather, or events outside our control. For lost packages confirmed by the carrier, we will arrange a replacement at no cost. For packages marked "delivered" by the carrier but reported missing by the customer, we may require an investigation by the carrier before issuing a replacement.
5.4 Gift orders
Damage and defect claims for orders sent as gifts may be submitted by either the buyer or the recipient, but the original order number is required. Replacements will be sent to the original shipping address unless otherwise agreed in writing.
5.5 International orders
For orders shipped outside the United States, the customer is responsible for any customs duties, import taxes, or fees imposed by the destination country. Refusal of a package due to customs charges does not qualify as a damage or defect claim, and shipping costs will not be refunded. Damage claims for international orders are subject to the same 7-day window and evidence requirements as domestic orders.
5.6 Chargebacks and disputes
If you believe an order qualifies for a replacement under section 5.2, please contact us first. Initiating a chargeback or payment dispute without first contacting us at support@mindtheskinlabs.com may result in the dispute being defended with reference to this policy. We respond to all good-faith claims within 24 hours and will work with you to resolve any legitimate issue.
5.7 Your statutory rights
Nothing in this policy limits or excludes your statutory rights as a consumer under applicable law, including (where relevant) the consumer protection laws of your state or country of residence, the UK Consumer Rights Act 2015, EU consumer protection directives, and the Australian Consumer Law. This policy describes the additional commitments Mind The Skin makes beyond those statutory rights.
6. Intellectual Property
All content on our website, including text, graphics, logos, product names, and images, is owned by or licensed to Mind The Skin, Inc. and protected by copyright and trademark laws.
You may not reproduce, distribute, modify, or use our content without written permission.
7. Product Information and Medical Disclaimer
Mind The Skin products are cosmetic in nature. Information provided on our website or packaging is for general informational purposes only and is not a substitute for medical advice.
Always consult a qualified healthcare provider for medical concerns. Discontinue use if irritation or discomfort occurs.
8. Limitation of Liability
To the fullest extent permitted by law, Mind The Skin, Inc. is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or website.
Our total liability for any claim related to your use of the Services will not exceed the amount you paid for the product that caused the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Mind The Skin, Inc., its officers, employees, and affiliates from any claims, damages, or expenses arising from your misuse of the website or violation of these Terms.
10. Privacy
Your use of our Services is also governed by our Privacy Policy, which explains how we collect and protect your personal information.
